The surprising ruling this week by a Federal Judge appointed by Trump has legal experts wondering if Trump can be successfully prosecuted.

Search Warrant Reveals Criminal Investigation
It was Trump's own legal team that requested that the search warrant of his Mar-a-Lago home be released—and the redacted document is not good for Trump.
The redacted search warrant of Trump's residence at Mar-a-Lago revealed the Justice Department's ongoing criminal investigation: “There is probable cause to believe that additional documents that contain classified NDI (National Defense Information) or that are presidential records subject to record retention requirements currently remain at the premises. There is also probable cause to believe that evidence of obstruction will be found at the premises.”
Trump "Under Siege"
The FBI conducted a court-authorized search of Trump's Mar-a-Lago residence as part of an ongoing criminal investigation.
Trump is facing multiple federal and state criminal investigations including the destruction and removal of classified documents, election tampering, wire fraud, and the January 6 attack on the Capitol. The legally obtained federal search warrant has Trump complaining to MAGA world that the “FBI broke into my safe” and that his residence “is currently under siege, raided, and occupied.”
Text Message Scandals
The illegal deletion of Secret Service and Pentagon text messages is a growing public scandal that appears to be part of a January 6 Insurrection cover-up.
Text messages have exposed lies and hypocrisy of Republicans close to Donald Trump. Trump's DHS inspector general attempted to "cover-up" deleted Secret Service text messages from the attack on the Capitol. In an unexpected twist, The January 6 committee has requested phone data recovered from conspiracy theorist Alex Jones who helped organize Trump's Stop the Steal rally.

Trump may soon announce he is running for president to avoid criminal prosecution. Expanding congressional, federal and state investigations have exposed how Trump knowingly lied about 2020 election fraud as part of a criminal conspiracy to overturn the election. “To win,” said Steve Bannon “Trump would say anything, he would lie about anything.”

Top White House aide testifies how Trump conspired to use a violent mob to overturn the election and tweeted encouragement to a violent mob chanting, "Hang Mike Pence."
Cassidy Hutchinson, executive assistant to Chief of Staff Mark Meadows, gave detailed and devastating testimony on how Trump knew the Jan 6 rioters were armed with weapons and still encouraged violence against the Vice-President. Hutchinson testified, “As an American, I was disgusted, it was unpatriotic, it was un-American."
Mass Resignations and Pardons
Trump's criminal plan to involve the Department of Justice in his election lies was only stopped by the threat of mass resignations.
The January 6 Committee heard testimony from the DOJ leadership about how Trump pressured them to support his election lies or be replaced by his co-coup plotter Jeffrey Clark, whose home was raided this morning by federal agents. It was also revealed during the hearings how multiple members of Congress requested preemptive pardons for themselves and all 147 Republican members who voted to overturn the election.
Conspiracy Theories and Thug Violence
Trump threatened government officials who refused to support his criminal conspiracy to overturn the election.
Public officials testified how Trump used threats to pressure them into supporting unsubstantiated conspiracy theories, alter the official vote, and fake electors in an illegal attempt to overturn the election. When direct pressure failed, Trump resorted to public lies and false accusations that resulted in violent threats against them and their families. Liz Cheney speaking to her Republican colleagues warned, “We cannot let America become a nation of conspiracy theories and thug violence.”
The Big Rip-Off
The January 6th Committee exposes how Trump knew he lost the election, but raised over $250 million spreading the Big Lie.
For Donald Trump it has always been about money. Although Trump was repeatedly told by his closest aides that he lost the election, he continued to raise millions spreading false conspiracy theories. Trump even defrauded his supporters with a bogus “Official Election Defense Fund" that did not exist. Rep. Zoe Lofgren correctly said at the hearing, “The Big Lie was also a big rip-off.”
Five Top Republicans Summoned
Rep. Kevin McCarthy has been subpoenaed by the Jan. 6 Committee in an extraordinary step targeting a current party leader.
Significant Republican names have been subpoenaed by the Jan. 6 Committee on Thursday for playing a crucial role and possibly hiding what they may know about the Attack. Aside from McCarthy, those subpoenaed includes Reps. Scott Perry (R-Pa.), Jim Jordan (R-Ohio), Andy Biggs (R-Ariz.) and Mo Brooks (R-Ala.). On the executive side, the DOJ has also subpoenaed Trump documents that were illegally brought to his home in Mar-a-Lago.
Trump Wanted To Shoot Americans
Trump was furious that George Floyd and BLM demonstrations made him look weak and threatened to use the military to shoot peaceful protesters.
Former Defense Secretary Mark Espers revealed that a "red-faced" Trump wanted to shoot Americans protesting the murder of George Floyd. Trump also threatened to invoke the Insurrection Act to deploy active-duty military against protesters. In other news, Jury selection begins in Georgia to investigate Trump's attempts to overturn the election and a federal Judge allows January 6 committee to subpoena Trump and RNC email data.
Republican Liars and Traitors
Text messages, public records, and voice recordings are exposing the hypocrisy and lies of the GOP leadership.
Mark Meadows, Kevin McCarthy, and Marjorie Taylor Greene are just the latest examples of Republicans who continue to lie about the January 6 Insurrection, even when contradicted by their own text messages and voice recordings. Elizabeth Warren called out the "illness that pervades the Republican leadership right now, they say one thing to the American public and something else in private." Warren also called Kevin McCarthy, "a liar and a traitor."
The GOP of Political Cowards
Kevin McCarthy and Mitch McConnell told Republican leaders that Trump was responsible for the January 6 Insurrection, but then lacked the courage to take action.
In the days following the January 6 Insurrection, Mitch McConnell and Kevin McCarthy told GOP colleagues that Trump was responsible for the attack on the Capitol. McCarthy even boasted that he would tell Trump to resign immediately, while McConnell said, “If this isn’t impeachable, I don’t know what is.” Unfortunately the two top GOP leaders in Congress lacked the political courage to publicly oppose Trump and refused to support impeachment.
Two More Held in Contempt of Congress
On Wednesday, the House voted to charge former trade and manufacturing director Peter Navarro and former White House communications chief Daniel Scavino Jr. with contempt of Congress
Navarro and Scavino are the latest among the top Trump aides to be charged, along with Steve Bannon and former chief of Staff Mark Meadows. The House voted as a result of both aides refusing to comply with the investigation. The split vote, 220-to-203, among party lines, initiated steps that ultimately end with the Justice Department's prerogative to pursue prosecution. If pursued, the case could result in a year in prison and a fine of up to $100,000.
Seven Hours and 37 Minutes
Missing White House phone records on January 6 is strong evidence of a cover up to hide Trump's criminal intent to overturn the 2020 election.
Despite reports of Trump's calls with several lawmakers, official White House phone records show no calls from 11:17 a.m. to 6:54 p.m. on January 6. Bob Woodward, who broke the story, said that Trump is a known phone “addict” and that Trump not using a phone for over 7 hours during the assault on the Capitol is as improbable as “the sun not rising.” The January 6 Committee is investigating a “possible coverup” as the investigation focuses on new evidence of Trump's criminal intent.
Trump is a "Would-Be Tyrant"
Republicans are speaking out about how Trump has weakened NATO and admires tyrants.
Former White House press secretary Stephanie Grisham said recently that Donald Trump both feared and admired Vladimir Putin and wanted "to kill whoever spoke out against him." Rep. Adam Kinzinger's "Biggest Regret" is not voting to impeach Trump over his "shameful and illegal act" of withholding "lethal aid to Ukraine so he could use it as leverage for his campaign. Rep. Tom Rice said Trump is "consumed by spite" and is a "would-be tyrant."
Trump "Weakened Ukraine"
Trump has a long financial history with Russia and supported Putin's efforts to subjugate Ukraine by withholiding military aid and weakening NATO.
For years, Trump had business relations with Russia, including trying to build a Trump Tower in Moscow. As president, Trump wanted to pull out of NATO and resisted efforts to sanction Russia. Trump was impeached for withholding $400 million in U.S. aid to Ukraine unless President Zelenskyy agreed to dig up dirt on Joe Biden. U.S. Army lieutenant colonel Vindman - who testified at the first impeachment - said recently that Trump has "undermined U.S. foreign policy because he weakened Ukraine.”
Ruling Could Doom Trump
Last Friday District Judge Amit Mehta ruled on three civil suits against Trump related to Jan. 6, allowing them to move forward with the case.
The ruling by Judge Mehta creates important rippling effects on Trump's Jan. 6 investigation as the ruling allows the three plaintiffs to seek information on Trump's role in the Jan. 6 Insurrection. Despite Trump's lawyers arguing on the basis of presidential immunity as well as his First Amendment right, Judge Mehta writes that Trump addressed the crowd not with presidential, but personal matters, and that the president's previous creation of "distrust and anger" made his event more than a speech but also a "call to action".

For the Trump family it's all about the Benjamins, but now with the government following the money, Donald Trump will have to testify under oath about potential financial fraud at the Trump Org.
Tax evasion and financial fraud may be Donald Trump's undoing. For decades Trump has avoided paying little or no income taxes and at the same time using "fraudulent and misleading asset valuations" to secure bank loans. Now a New York state judge has ordered Donald Trump and his two oldest children to testify under oath, although they are likely to invoke their Fifth Amendment right against self-incrimination, just like Eric Trump did 500 times back on October 5, 2020.
